Fātimah bint Qays (may Allah be pleased with her) reported that Abu ‘Amr ibn Hafs divorced her irrevocably, while he was not present (and in another narration: “divorced her thrice”). He sent some barley to her with his representative and she was displeased with it. So he said: “By Allah, you are not entitled to receive anything from me.” She came to the Messenger of Allah (may Allah's peace and blessings be upon him) and mentioned that to him. He said: “No financial maintenance is due to you upon him. (In another narration: 'or accommodation’)” Then the Prophet (may Allah's peace and blessings be upon him) ordered her to observe her ‘Iddah (post-divorce waiting period) in the house of Umm Sharīk; then he said: “This is a woman whom my Companions frequently visit, so observe your ‘Iddah at the house of Ibn Umm Maktūm. He is a blind man and you can disrobe in his house. Then when you complete your ‘Iddah, inform me.” She said: “When I completed my ‘Iddah, I mentioned to him that both Mu‘āwiyah ibn Abu Sufyān and Abu Jahm proposed to me. Thereupon, the Messenger of Allah (may Allah's peace and blessings be upon him) said: ‘As for Abu Jahm, he never takes his stick off his shoulder, and as for Mu‘āwiyah, he is destitute and penniless. Marry Usāmah ibn Zayd,’” whom she disliked. Then he said: “Marry Usāmah ibn Zayd.” Fātimah said: “So I married him and Allah placed a lot of good in him, and I was pleased with him.”

عن فاطمة بنت قيس- رضي الله عنها- «أن أبا عمرو بن حفص طلقها البَتَّةَ، وهو غائب (وفي رواية: "طلقها ثلاثا")، فأرسل إليها وكيله بشعير، فسخطته. فقال: والله ما لك علينا من شيء. فجاءت رسول الله صلى الله عليه وسلم فذكرت ذلك له، فقال: ليس لك عليه نفقة (وفي لفظ: "ولا سكنى") فأمرها أن تَعْتَدَّ في بيت أم شريك؛ ثم قال: تلك امرأة يَغْشَاهَا أصحابي؛ اعتدي عند ابن أم مكتوم. فإنه رجل أعمى تضعين ثيابك، فإذا حَلَلْتِ فآذِنِيني. قالت: فلما حللت ذكرت له: أن معاوية بن أبي سفيان وأبا جهم خطباني. فقال رسول الله صلى الله عليه وسلم : أما أبو جهم: فلا يَضَعُ عصاه عن عاتقه. وأما معاوية: فصعلوك لا مال له. انكحي أسامة بن زيد. فكرهته ثم قال: انكحي أسامة بن زيد. فنكحته، فجعل الله فيه خيرا، واغْتَبَطْتُ به».
Understand this hadith

Abu ‘Amr ibn Hafs divorced his wife Fātimah bint Qays irrevocably, and it was the third and last time to divorce her. The woman who is irrevocably divorced has no right to receive financial maintenance from her husband, yet he sent her some barley. She thought that as long as she was in her post-divorce waiting period ‘Iddah, her maintenance was due to her upon him, so she thought the barley was too little and hated it. He, thus, swore that nothing was due to her upon him. She complained about this to the Messenger of Allah (may Allah's peace and blessings be upon him) and he informed her that he was not obliged to provide for her or provide her with accommodation. Then he ordered her to spend her ‘Iddah in the house of Umm Sharīk. When he remembered that the Companions frequently visit the house of Umm Sharīk, he ordered Fātimah to spend her ‘Iddah at the house of Ibn Umm Maktūm, because he was a blind man and would not see her when she would take off her clothes. He ordered her to inform him when her ‘Iddah would be over. When she completed her ‘Iddah, both Mu‘āwiyah and Abu Jahm proposed to her, so she consulted the Prophet (may Allah's peace and blessings be upon him). As sincere advice is mandatory – especially for the one who seeks counsel – the, Prophet (may Allah's peace and blessings be upon him) did not advise her to marry any of them, since Abu Jahm was harsh with women and Mu‘āwiyah was poor and penniless. Instead, he ordered her to marry Usāmah, but she disliked that because he was a freed slave. However, she obeyed the command of the Prophet (may Allah's peace and blessings be upon him) and accepted Usāmah. She was pleased with him, and Allah placed a great deal of good in him.

A man divorced his wife three times, then another man married her and divorced her before consummating the marriage with her. Her first husband wanted to remarry her, and the Prophet (may Allah's peace and blessings be upon him) was asked about that. He said: No, not until the second husband tastes of her sweetness what the first one tasted

‘Ā’ishah (may Allah be pleased with her) reported: A man divorced his wife three times, then another man married her and divorced her before consummating the marriage with her. عن عائشة رضي الله عنها ، قالت: طلَّق رجل امرأَته ثلاثا، فَتَزوَّجها رجل، ثم طلَّقها قَبْل أن يَدْخُل بها، فَأَراد زوجها الأول أن يتزوَّجها، فسُئِل رسول الله صلى الله عليه وسلم عن ذلك، فقال: «لا، حتى يَذُوَق الآخرُ مِنْ عُسَيْلَتِها ما ذَاقَ الأوَّل».
Understand this hadith

The wife of Rifā‘ah al-Qurazi came to the Prophet (may Allah's peace and blessings be upon him) and told him that she was married to Rifā‘ah but that he then divorced her thrice, making the divorce irrevocable. She added that she then got married to ‘Abdur-Rahmān ibn Az-Zabīr, who also divorced her after his failure to have sexual intercourse with her. Her first husband wanted to remarry her, and she asked the Prophet (may Allah's peace and blessings be upon him) about that. The Messenger of Allah (may Allah’s peace and blessings be upon him) forbade this remarriage and told her that the permissibility of her remarriage to Rifā‘ah is conditional on having had sexual intercourse with her last husband.

Divorce whomever of them you wish

Ad-Dahhāk ibn Fayrūz reported from his father that he said: "I said: 'O Messenger of Allah, I have embraced Islam, and I have two sisters as wives!' He said: 'Divorce whomever of them you wish.'"

Understand this hadith

Fayrūz ad-Daylami (may Allah be pleased with him) was a Companion from Yemen. He was married to two sisters when he embraced Islam. In the pre-Islamic period of ignorance, people used to combine two sisters in marriage without finding fault with that. Therefore, the Prophet (may Allah's peace and blessings be upon him) commanded Fayrūz to keep one of the two sisters as his wife and divorce the other. In Islam, it is not permissible to combine two sisters in marriage.

عن أبي هريرة أن رسول الله صلى الله عليه وسلم قال: "ثلاث جِدُّهُنَّ جِدٌّ، وهَزْلُهُنَّ جِدٌّ: النكاح، والطلاق، والرَّجْعَةُ".
Understand this hadith

This Hadīth shows that anyone who pronounces words of marriage, divorce, or restoration of a divorcee, even jokingly, his words are legally binding, for in these rulings, words are binding regardless of whether they were serious or not. For example, if a man conducts a marriage contract of his female authorizer, divorces his wife, or restores her verbally, his words become legally binding as soon as he pronounces them regardless of whether he is serious or not. In this type of contracts, the option to revoke in the same session or based on specific stipulations is not available. As these three matters are given great importance in the Shariah, they are not liable to playful treatment or joking, and thus mere utterance of their words makes them legally binding.

The son of Adam cannot make a vow concerning what is not his; he cannot free a slave who is not his; and he cannot divorce a woman who is not his (wife)

عن عمرو بن شعيب، عن أبيه، عن جده قال: قال رسول الله صلى الله عليه وسلم : «لا نَذْرَ لابن آدم فيما لا يملك، ولا عِتْقَ له فيما لا يملك، ولا طلاق له فيما لا يمْلِك».
Understand this hadith

In this Hadīth, the Prophet (may Allah's peace and blessings be upon him) explains that one can handle only things that he owns, and that disposing of things that one does not own is void. This rule applies to the acts mentioned in the Hadīth as follows: 1. The vow: Making a vow concerning a thing that one does not own at the time of making the vow is void. Even if one comes to own that thing later, he neither has to fulfill his vow nor offer expiation. 2. Emancipation of a slave: One cannot free a salve who is not his, because emancipation in this case in objectless. 3. Divorce: It is void if made by a man concerning a woman who is not his wife, because the right of divorce belongs exclusively to the husband who has the right to intimacy, and also because the Prophet (may Allah's peace and blessings be upon him) said: “One cannot divorce a woman who is not his (wife)”.
