Rulings and Issues of Jihad

Narrated by MuslimAuthentic hadith

No invading group or detachment sets out to fight in the cause of Allah and gets its share of the booty and returns safe and sound, but it has been given two-thirds of its reward in this world. On the other hand, no invading group or detachment returns defeated and injured but it will receive its full reward in the Hereafter

Narrator in the source: ‘Abdullāh ibn ‘Amr ibn al-‘Aas reported that the Prophet

‘Abdullāh ibn ‘Amr ibn al-‘Ās (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: “No invading group or detachment sets out to fight in the cause of Allah and gets its share of the booty and returns safe and sound, but it has been given two-thirds of its reward in this world. عن عبد الله بن عمرو بن العاص رضي الله عنهما مرفوعاً: «ما من غازيَةٍ أو سَرِيَّةٍ تغزو فَتَغْنَم وَتَسْلَمُ إلا كانوا قد تَعَجَّلُوا ثُلُثَي أُجُورِهِمْ، ومَا من غَازِيَةٍ أَوْ سَرِيَّةٍ تُخْفِقُ وَتُصَابُ إِلاَّ تم أُجُورُهُمْ».
Understand this hadith

There are two possible interpretations of this Hadīth: First: The reward of any detachment, which fought the enemy and was safe and received its share of the booty, is less than the reward of another detachment that was injured and took no booty. This interpretation is favored by An-Nawawi (may Allah have mercy upon him). Second: The Hadīth is a proof that the war booty is lawful and does not reduce the reward. Simply, part of the reward is received in this world instead of the Hereafter, and both teams shall receive equal rewards. The victorious one, however, receives two thirds of its reward in advance in this world, but their overall reward is equal. In the Hereafter, Allah compensates those who missed the booty with an amount equal to what they missed, and Allah multiplies the reward for whomever He likes. This is the interpretation of Ibn ‘Abd al-Barr (may Allah have mercy upon him).

Whoever learns archery (shooting arrows) or the like, such as shooting with bullets in our present time, for the sake of Allah, then stops practicing it, has indeed exposed himself to bearing a sin for that and has strayed from the guidance of the Prophet (may Allah's peace and blessings be upon him). The narrator used "is not one of us", and "has indeed disobeyed" because he was uncertain of the exact wording of the Prophet (may Allah's peace and blessings be upon him).

The sanctity of the wives of the Mujāhids for those who stay behind is like the sanctity of their own mothers

Understand this hadith

The basic principle is that a woman is unlawful to her non-Mahram males, and the unlawfulness is emphasized regarding the wives of those who have set out to fight for the sake of Allah and left their wives behind, and entrusted them to the men who did not go out for Jihad. It is obligatory for those men to be cautious lest they should violate those wives' honor, by being alone with them, gazing at them, or speaking lewdly to them. These wives are as unlawful for them (to marry) as their mothers. This is because the Mujāhids have entrusted their families to the care of those men, and, therefore, the Prophet (may Allah's peace and blessings be upon him) advised that it is the duty of each of those men to do his duty towards them and not betray the Mujāhid's trust by looking at his wife or attempting any indecent behavior or by being negligent in looking after their affairs, doing what is good for them, and warding harm off them. "Anyone who stays behind looking after the family of a Mujāhid and betrays his trust will be made to stand on the Day of Judgment before the Mujāhid who will take away from his good deeds as much as he likes until he is satisfied." This means: Whoever dares to violate the honor of the wives of Mujāhids in their absence, and betrays them with regards to their wives, then Allah will enable the Mujāhid over him on the Day of Judgment whereby the Mujāhid will take from his good deeds as much as he wants until he is satisfied and pleased. Then the Prophet (may Allah's peace and blessings be upon him) said: "So what do you think (will he leave anything)?" i.e. How do you think the Mujāhid would take advantage of this chance of acquiring a large amount of good deeds? In other words, nothing will remain, as he will take all of that man's good deeds.

Understand this hadith

This Hadīth indicates that if a person is attacked by a thief or a usurper who tries to take his property forcefully without legal basis, then he has the right to fight the intruder in defense of his property. If he is killed while defending his property, he will be a martyr in the sight of Allah, the Exalted, and he will be given the same reward as that of martyrs. However, this does not mean that he should be treated like a person who is killed in a battlefield in the sense that his dead body should not be washed. Likewise, the same applies to a person who dies while defending himself or his honor against a person who wants to violate the honor of his wife or Mahrams. Such a person will be given the reward of martyrs by Allah, the Exalted. This Hadīth is a primary evidence for jurists in juristic issues known as repelling the intruder or attacker.

As he was going to face a very long journey through a wasteland and was to meet and attack a large number of enemies. So, he made the situation clear to the Muslims so that they might prepare themselves accordingly and get ready to conquer their enemy. As related in this Hadīth, whenever the Prophet (may Allah's peace and blessings be upon him) set out for a battle, he would ask about a certain route other than the intended one so as to deceive the enemy and prevent spies from reporting their news. He wanted to reach the enemy while they were unprepared for the confrontation. An exception was the battle of Tabūk. As it would entail a long and arduous journey, he did not conceal the destination. And Allah, the Almighty, granted Muslims victory over the disbelievers.

The Prophet (may Allah's peace and blessings be upon him) asked him the same question again, and the man gave him the same answer. he said: "Then go back, for I will not seek help from a polytheist." Understand this hadith

This Hadīth shows that when the Prophet (may Allah's peace and blessings be upon him) set forth to fight the disbelievers on the Day of Badr, a polytheist who was strong and courageous followed him to fight with him and get a share of the booty. The Prophet (may Allah's peace and blessings be upon him) asked him whether he believed in Allah and the Last Day, and the man told him that he did not. So the Prophet (may Allah's peace and blessings be upon him) stated that he would not seek the help of a polytheist, for polytheists are not to be trusted with protecting the believers. Treacherous as they could be, they might convey the news of Muslims to the disbelievers. However, the man came again to the Prophet (may Allah's peace and blessings be upon him) who then asked him whether he became a Muslim, and the answered in the affirmative. Hence, he asked him to join the army. The point of the Hadīth is that it is not permissible to seek the help of the polytheists in fighting, although it is permissible in the case of need and necessity, as indicated by other proofs.

The Muslim jurists say that if the Muslims take prisoners of war, the Imām has four choices regarding them. These choices should be based upon the ruler's keenness to realize the best interest of Muslims. They are: killing them, enslaving them, setting them free for nothing, or setting them free for money or in exchange for Muslims imprisoned by the disbelievers.

Understand this hadith

It is permissible, according to this Hadīth, to assign extra spoils to an army detachment, in addition to the shares they receive, in appreciation of their effort in Jihad. If the detachment makes an incursion at the beginning of the journey to Jihad, they shall be given a quarter of the booty they gain. If they make an incursion after the return of the Jihad fighters, they shall be given a third of the booty they gain and they share the rest of the booty (three-quarters or two-thirds) with the rest of the army. They receive more after Jihad than before, because the soldiers are weak then and the detachment has less support than if they make an incursion before Jihad is launched. Also, they deserve more because they are fighting at a time when they have an intense desire to going home and see their families.
