Verily, if one of you insists on fulfilling an oath by which he may harm his family that is more sinful in the sight of Allah, the Almighty, than breaking the oath and paying the (oath-breaking) expiation that Allah imposed

Narrator in the source: Abu Hurayrah reported: I heard the Messenger of Allah say:

عن أبي هريرة رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم : «لأَنْ يَلَجَّ أحدُكم في يَمِينِه في أهْلِه آثَمُ له عند الله تعالى من أن يُعْطِي كَفَّارَتَهُ التي فرض الله عليه».
Understand this hadith

The meaning of this Hadīth is that if a Muslim took an oath concerning his family, whereby they will be harmed if he does not break the oath and breaking it would not constitute disobedience to Allah, the Almighty, yet he still insists on fulfilling the oath, fulfilling the oath would be a greater sin than breaking it and paying the legislated expiation for breaking the oath. In other words, he should pay the expiation for breaking his oath instead of insisting on fulfilling it, as long as breaking it does not involve disobedience to Allah. In fact insisting on fulfilling the oath is a greater sin, because it causes harm to his family, and Allah has made the matter flexible for him. Another report reported by Al-Bukhāri and Muslim reads: “If you take an oath to do something and then you find that something else is better, you should do what is better and expiate for breaking your oath."

Hadīth explanation: Whoever swears saying that he has nothing to do with Islam, or saying that he is a Jew, a Christian, a disbeliever, or an atheist; then his case is either of the two: The first case: that he is lying in what he swears about; such as saying: “If such and such matter is not true, then I have nothing to do with Islam,” while he is lying about it. For example, saying: Zayd arrived today from his trip, and if it is not true then I have nothing to do with Islam, or I am a Jew, a Christian or a polytheist; while he knows that is lying (that Zayd did not arrive today). The second case: that he is telling the truth; for example, if he said: Zayd arrived today from his trip, and if it is not true then I have nothing to do with Islam, or I am a Jew or a Christian. If he is truthful (Zayd did arrive today), then, in this case, his Islam will not be perfect anymore as the Messenger (may Allah's peace and blessings be upon him) said. Rather, his Islam will be deficient because of those heinous words he uttered.

In prayer, nothing of people's ordinary speech is allowed. Only Tasbīh, Takbīr, and recitation of the Qur'an are allowed

Narrator in the source: معاوية بن الحكم السلمي

Mu‘āwiyah ibn al-Hakam As-Sulami (may Allah be pleased with him) reported: While I was praying with the Messenger of Allah (may Allah's peace and blessings be upon him) a man sneezed, so I said: "May Allah have mercy upon you." People looked at me disapprovingly, so I said: "May my mother lose me, why do you stare at me?" They began to strike their thighs with their hands, and when I saw them urging me to be silent I said nothing. When the Messenger of Allah (may Allah's peace and blessings be upon him) finished the prayer – and may my father and mother be sacrificed for him! I have never seen a mentor before him nor after him who gave better instruction than him. By Allah, he neither scolded me, nor beat me, nor insulted me, rather he said: ‘In prayer, nothing of people's ordinary speech is allowed. Only Tasbīh, Takbīr, and recitation of the Qur'an are allowed." Or he said something similar to that. Then I said: "O Messenger of Allah, I have recently abandoned the beliefs of the pre-Islamic era, and Allah has brought Islam to us, and there are men among us who go to diviners." He said: "Do not go to them." I said: "There are men who believe in omens." He said: "That is something which they find in their hearts, but let it not prevent them (from doing whatever they intend to do) (Ibn As-Sabbāh said: let it not prevent you)." I said: "Among us are men who draw lines." He said: "There was a prophet who used to draw lines, so if their lines are as his, then that will be good." He (Mu‘āwiyah) added: "I had a bondmaid who tended sheep for me by the side of Uhud and Al-Jawwāniyyah. One day, I happened to pass that way and found that a wolf had snatched a ewe from her flock. As a normal human being, I got angry and gave her a slap. Then I came to the Messenger of Allah (may Allah's peace and blessings be upon him) who considered my act of slapping her grievous, so I said: 'O Messenger of Allah, should I emancipate her?' He said: 'Bring her to me.' So I brought her to him, and he said to her: 'Where is Allah?' She said: 'He is in the heaven.' He said: 'Who am I?' She said: 'You are the Messenger of Allah.' He said: 'Set her free, for she is a believing woman.'"

Mu‘āwiyah ibn al-Hakam As-Sulami (may Allah be pleased with him) relates what happened when he was praying with the Prophet (may Allah's peace and blessings be upon him) in one of the congregational prayers. He heard a man sneeze and say: "Praise is due to Allah," so he responded immediately by saying: "May Allah have mercy upon you," based on the statement of the Prophet (may Allah's peace and blessings be upon him): "When anyone of you sneezes, he should say 'Praise be to Allah,' and his brother or companion should say 'May Allah have mercy upon you.'" Mu‘āwiyah (may Allah be pleased with him) was unaware that responding to the one who sneezes by saying "May Allah have mercy upon you” is recommended outside the prayer. "People looked at me disapprovingly," i.e. they gave him a critical look without speaking. He did not know the reason for their disapproval, so he said: "May my mother lose me," i.e. I am doomed. "Why do you stare at me?" i.e. what makes you look at me with such anger? "They began to strike their thighs with their hands," i.e. expressing more disapproval. He understood that they wanted him to be silent and stop talking, so he said nothing. He was wondering about the ugliness of what he had done, and their exaggerated disapproval of his action. He wanted to argue with them, but he said nothing out of compliance, because they were more knowledgeable than him. So, he did not act on his anger or ask them about the reason for their disapproval. When the Messenger of Allah (may Allah's peace and blessings be upon him) finished the prayer, he was not harsh with him, nor did he reproach him. Rather, he explained to him the Shariah ruling in a way that made it more likely to be accepted and obeyed. "By Allah, he neither scolded me, nor beat me, nor insulted me", rather he gently explained the Shariah ruling, saying: "In prayer, nothing of people's ordinary speech is allowed. Only Tasbīh, Takbīr, and recitation of the Qur'an are allowed", i.e. it is unlawful for people to converse with one another in prayer, it was permissible in the early days of Islam but was later on abrogated. What is permissible during the prayer is: glorifying Allah, declaring His greatness, and recitation of the Qur'an. He told the Messenger of Allah (may Allah's peace and blessings be upon him) that he had recently abandoned the pre-Islamic beliefs and reverted to Islam, hence, he was not aware of all the rulings of religion. He then mentioned that some of his companions go to diviners, and ask them about matters of the unseen that will occur in the future. The Prophet (may Allah's peace and blessings be upon him) forbade him from going to diviners because they speak about matters of the unseen, and some of their predictions may coincide with reality, and this could be misleading. There are many corroborating authentic Hadīths that demonstrate the prohibition of going to diviners, and believing what they say, as well as paying their fees. Mu‘āwiyah then mentioned the belief in omens, i.e. feeling pessimistic based on something seen or heard, or based on a certain time or place. The Arabs were known for their belief in evil omens, to the point that if one of them intended to do something good, and then he saw birds fly to the right or left – depending on what was known among them – he would delay what he wanted to do. Also, among them were those who would hear a sound or see a person and take it as an evil omen, or those who would be pessimistic about getting married in the month of Shawwāl, or those who would be pessimistic about Wednesday, or the month of Safar. All of this was invalidated by the divine legislation, due to its negative effect on one's mind, thinking, and attitude. Paying no attention to such things represents reliance on Allah. The Prophet (may Allah's peace and blessings be upon him) commented on that saying that pessimism is an involuntary feeling, and there is no blame on one in this regard. However, one should not let such pessimism prevent him from managing his affairs, which is something he can control, and one is thus held accountable for. The Prophet (may Allah's peace and blessings be upon him) forbade them from acting on omens, and letting such belief in evil omens prevent them from managing their affairs. There are authentic Hadīths that collectively demonstrate the prohibition of believing in omens, which here refers to acting upon them, not to what one feels about them without his actions being affected. "I said: 'Among us are men who draw lines'": According to the Arabs, drawing lines meant that a person would bring a diviner and in front of him would be a boy whom he would order to draw several lines on the sand. Then he would order him to erase them two at a time, then he would look at what finally remained of those lines. If an even number remained, then this would be a proof of happiness and prosperity. If an odd number remained, then this would be a proof of disappointment and hopelessness. The Prophet (may Allah's peace and blessings be upon him) said that there was a Prophet who used to draw lines, like the lines drawn in the sand, and would know about matters through perspicacity by the position of those lines. This prophet was either Idrīs (Enoch) or Danyāl (Daniel) (peace be upon them). So if their lines were as the lines of that Prophet (may Allah's peace and blessings be upon him) that would be permissible. However, there is no way for us to know for certain that it is done in the same manner of that prophet, so it is not permissible. This statement denotes the prohibition of such a practice, because it is not permissible except with certainty that it is the same as that done by that prophet, and we are not certain. One possibility is that this practice was abrogated in our divine legislation. Another possibility is that the permissibility of drawing lines was a sign on the prophet-hood of that prophet, and it has ceased; so we have been prohibited from practicing it. In sum, the Hadīth indicates the unlawfulness of practicing geomancy, not its permissibility. Furthermore, it indicates the invalidity of the manner in which people practice it, because practicing it in the same way as that prophet requires knowledge of it, and knowledge comes through one of the following ways: 1. A clear, authentic text that clarifies the manner of this science. 2. An uninterrupted transmission concerning this matter from the time of that prophet to the time of the Prophet (may Allah's peace and blessings be upon him). Both ways do not exist. It is worth mentioning in this context that prophets do not claim knowledge of the unseen, and they never inform people that they know the unseen. Whatever they informed people of unseen matters was only learnt through revelation from Allah, and they never attributed it to themselves. Allah, the Almighty, says (what means): {The All-Knower of the unseen, and He reveals to none His unseen. Except to a messenger whom He has chosen, and then He makes a band of watching guards to march before him and behind him} [Sūrat al-Jinn: 26-27]. That is because the unseen is part of that knowledge which is exclusive to Allah, and no one claims it for himself except a person who claims to share with Allah some of the characteristics of Lordship. That is exactly what the masters of this craft do. Hence, the fraud of these people appears in their claim that this prophet is their teacher. Mu‘āwiyah then mentioned that he had a bondmaid who tended his sheep in a place close to Mount Uhud. One day he happened to pass that way and found out that a wolf had killed one of the sheep that belonged to him. He became angry and wanted to beat her severely for that, but he only gave her a slap. Then he went to the Messenger of Allah (may Allah's peace and blessings be upon him) who considered what he had done grievous. Mu‘āwiyah ibn al-Hakam As-Sulami (may Allah be pleased with him) asked if he should emancipate her, and the Prophet (may Allah's peace and blessings be upon him) ordered him to bring her to him. When he brought her, the Prophet (may Allah's peace and blessings be upon him) said to her: "Where is Allah?" i.e. where is the deity worthy of worship and characterized by traits of perfection? By this question, he wanted to make sure that she believed in the oneness of Allah, so he spoke to her by what would make his purpose understood, as the sign of those who believe in monotheism is their belief that Allah is in the heaven. She replied that Allah is in Heaven, meaning that He is above everything and above His Throne which is the canopy of the creation. He asked her about himself, and she replied that he was the Messenger of Allah. Thereupon, he ordered Mu‘āwiyah to set her free, for being a believing woman. Her replies were a clear proof of her faith and the soundness of her beliefs.

What made you come, Abu Hidhyam?

Narrator in the source: حنظلة بن حذيم

Hanzhalah ibn Hidhyam reported that his grandfather Haneefah said to Hidhyam: "Gather my children for me, because I want to leave a testament." When they were gathered, he said: "The first thing I bequeath is that this orphan of mine who is in my custody is entitled to one hundred camels, which were called Al-Mutayyabah (the good favored ones) in pre-Islamic times.'' Hidhyam said: "O my father, I heard your children say: 'We will approve of this during our father's life, but when he dies, we will recant it.'" He said: "So let the Messenger of Allah (may Allah's peace and blessings be upon him) judge between me and you." Hidhyam said: "We accept that." So Hidhyam, Haneefah, and Hanzhalah along with a young boy who escorted Hidhyam set forth. When they came to the Prophet (may Allah's peace and blessings be upon him) they greeted him. The Prophet (may Allah's peace and blessings be upon him): "What made you come, Abu Hidhyam?" He replied, having struck Hidhyam on the thigh: "I fear that old age or death will overtake me, so I wanted to make a bequest. I therefore said: 'The first thing I bequeath is that this orphan of mine who is in my custody is entitled to one hundred camels, which were called Al-Mutayyibah in pre-Islamic times.'" The Messenger of Allah (may Allah's peace and blessings be upon him) became so angry that we saw anger in his face. He was sitting, but he knelt down and said: "No, no, no! A charity should consist of five camels, or else ten, or else fifteen, or else twenty, or else twenty-five, or else thirty, or else thirty-five, or of a maximum of forty." They fared him well, and the orphan had a stick with him with which he was beating a camel. So the Prophet (may Allah's peace and blessings be upon him) noted: "That is a too big a stick for an orphan." Hanzhalah said: "My father drew me closer to the Prophet, may Allah's peace and blessings be upon him and said: 'I have sons with beards, and others younger than them, and this one is the youngest. So pray for him.'" Therefore, he wiped his head and said: "May Allah bless you," or: "May he be blessed." Dhayyāl said: "I have seen Hanzhalah, and a man with a swollen face or a beast with a swollen udder would be brought to him. He would spit on his hands and say "Bismillāh" (in the name of Allah); put his hand on his head, where the Messenger of Allah (may Allah's peace and blessings be upon him) had placed his hand; and then wipe [the affected part] with it." Dhayyāl said: "The tumor would disappear."

Hanzhalah ibn Hidhyam ibn Hanīfah narrates that his grandfather Hanīfah ordered his son Hidhyam to gather his children for him because he wanted to leave a testament before his death. The children gathered, and he told them that the orphan who was in his custody should be given one hundred camels. Before Islam, these camels were called the Mutayyabah, meaning: good camels that people liked for being from among the best camels. Hidhyam told his father that he heard his siblings say that they would approve of their father's will but that they would recant it on his death and would not give the orphan anything. So Hanīfah said that the Messenger of Allah (may Allah's peace and blessings be upon him) would judge between them. Hidhyam said that they were fine with the prospective judgment of the Prophet, may Allah's peace and blessings upon him. So Hidhyam; Hanīfah; and Hanzhalah, the son of Hidhyam — escorting his father — went to the Prophet (may Allah's peace and blessings be upon him) and greeted him. He asked Hanīfah (the father of Hidhyam) what had made him come over to him. Hanīfah pointed to Hidhyam, remarking that he feared that he would die before leaving a testament. He added that the first point of the bequest was that the orphan who was in his custody should be given one hundred camels, which were called, before Islam, the good and favorable ones. On that account, the Messenger of Allah (may Allah's peace and blessings be upon him) became so angry that they discerned that in his face. He changed his sitting position and knelt down. He said that a charity should consist of five camels, or else ten, or else fifteen, or else twenty, or else twenty-five, or else thirty, or else thirty-five, or a maximum of forty. He meant that charity is allowed if it does not exceed the third of one's wealth. They left him, and the orphan had a stick with him wherewith he drove a camel. So the Prophet (may Allah's peace and blessings be upon him) remarked that such a stick was too big for an orphan. By this, he meant that the orphan was a man of a big stature, and it was an exaggeration to call him an orphan, for he was not that young. Hanzhalah said that his grandfather drew him closer to the Prophet (may Allah's peace and blessings be upon him) and said that he had old bearded sons and younger children, and the youngest of them was Hanzhalah, so he asked the Prophet (may Allah's peace and blessings be upon him) to pray for him. The Prophet (may Allah's peace and blessings be upon him) wiped his head and invoked Allah's blessings on him. Dhayyāl, a narrator of this Hadīth, said that he later saw Hanzhalah being brought a man with a swollen face or a beast with sore udders, so he would spit on his hand; say: Bismillāh" (in the name of Allah); put his hand on his head where the Prophet (may Allah's peace and blessings be upon him) had put his hand; and then wipe the affected part of the man or beast, and the tumor would disappear.

Abu Hurayrah (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "‘Īsa the Son of Maryam saw a person stealing. عن أبي هريرة رضي الله عنه عن النبي صلى الله عليه وسلم قال: ««رأى عيسى ابنُ مريم رجلًا يَسْرِق، فقال له: أسَرَقتَ؟ قال: كلا والله الذي لا إله إلا هو، فقال عيسى: آمنتُ بالله، وكذَّبتُ عيني».

‘Īsa the Son Maryam (peace be upon him) saw a man stealing. He asked the man if he had stolen. The man swore by Allah that he had not. So ‘Īsa said that he believed in Allah and disbelieved in his own eyes. This means that he believed the man, for he swore by Allah, and ruled out that he ostensibly stole. The man could have taken something that belonged to him, or with its owner's permission, or not meaning to seize it unlawfully, or merely to look into it, etc. This illustrates how much the prophets glorify Allah, the Most High.

Loyalty is pledged to the one who did the favor

Narrator in the source: ‘Ā’ishah, Mother of the Believers, reported saying:

‘Ā’ishah (may Allah be pleased with her) bought Barīrah from a household belonging to the Ansār, and they stipulated that they retain the ex-slave's allegiance. The Messenger of Allah (may Allah’s peace and blessings be upon him) said: "Allegiance is pledged to the one who did the favor (of setting the slave free)." The Prophet (may Allah's peace and blessings be upon him) also gave Barīrah the choice (either to retain her marriage or break it), as her husband was a slave. She gave some meat to ‘Ā’ishah as a gift, and the Messenger of Allah (may Allah’s peace and blessings be upon him) said: "I wish you could cook this meat for us." ‘Ā’ishah said: "It was given in charity to Barīrah." He said: "It was charity to her but a gift to us."

According to this Hadīth, ‘Ā’ishah (may Allah be pleased with her) bought Barīrah and freed her, but her ex-master conditioned that they retain Barīrah's allegiance. The Messenger of Allah (may Allah’s peace and blessings be upon him) told her that this condition is void because allegiance is pledged to the one who did the favor of setting the slave free. Regarding Barīrah, she was married to a slave named Mughīth, so when she became higher than him (in rank) as a free woman with an independent will, the Prophet (may Allah's peace and blessings be upon him) gave her the choice either to retain her matrimonial bond or break it. Later, Barīrah received meat as charity and sent some of it to ‘Ā’ishah (may Allah be pleased with her) as a gift. The Messenger of Allah (may Allah’s peace and blessings be upon him) wanted to eat from that meat. ‘Ā’ishah (may Allah be pleased with her) told the Prophet (may Allah's peace and blessings be upon him) that it had originally been given in charity to Barīrah, and thus he was not allowed to eat from it. However, the Prophet (may Allah's peace and blessings be upon him) told her that Barīrah was given the meat as charity, while the Prophet (may Allah's peace and blessings be upon him) was given it as a gift from her. Therefore, the ruling of this meat changed from a charity to a gift, so eating it was allowable for the Prophet (may Allah's peace and blessings be upon him) and his household.

Narrator in the source: ‘Ā’ishah, Mother of the Believers, reported saying:

‘Ā’ishah (may Allah be pleased with her) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) liked sweets and honey, and whenever he finished the ‘Asr prayer, he would visit his wives and stay closely with them, one after another. He once visited Hafsah and remained with her for longer than usual. I inquired about it, and it was said to me: ‘A woman from her tribe gifted her a leather vessel containing honey, and she gave some of it to the Messenger of Allah (may Allah’s peace and blessings be upon him) to drink.’ I said: "By Allah, we will play a trick on him." So I mentioned the story to Sawdah and said to her: "When he visits you, he will come near you, whereupon you should say to him: 'O Messenger of Allah, have you eaten Maghafīr (bad-smelling gum)?' He will say: 'No.' Then say to him: 'What about this smell then?' It was very hard on the Messenger of Allah (may Allah’s peace and blessings be upon him) that a bad smell would emit from him. He will say: 'Hafsah has given me a drink of honey.' Then say to him: 'Its bees must have sucked from ‘Urfut (a foul-smelling plant).' I too will tell him the same. And you, O Safiyyah, also say the same.’ When the Prophet (may Allah's peace and blessings be upon him) visited Sawdah, the following happened, as related by Sawdah, who said: 'By the One other than Whom there is no god, I was about to tell him what you had told me while he was still at the door, out of fear from you.’ But when the Messenger (may Allah's peace and blessings be upon him) came near her, she said to him: ‘O Messenger of Allah, have you eaten Maghāfīr?’ He replied: ‘No.’ ‘I said: 'What about this smell then?' He said: 'Hafsah has given me a drink of honey.' I said: 'Its bees must have sucked ‘Urfut.'’ When he visited me, I told him the same, and when he visited Safiyyah, she too said the same. When he visited Hafsah again, she said to him: ‘O Messenger of Allah, shall I give you a drink of it (the honey)?’ He said: ‘I have no desire for it.’ Sawdah said: ‘Glory be to Allah! By Allah, we have deprived him of it.’ I said to her: ‘Keep quiet!’”

In this Hadīth, ‘Ā’ishah (may Allah be pleased with her) mentioned that the Messenger of Allah (may Allah’s peace and blessings be upon him) liked all sweet foods and honey, and that when he finished the ‘Asr prayer, he would visit his wives, one after another, and approach each of them, kissing and caressing her. She goes on to relate that the Prophet (may Allah's peace and blessings be upon him) once visited Hafsah (may Allah be pleased with her) and stayed with her for longer than usual. ‘Ā’ishah asked about the reason and learned that one of Hafsah’s female relatives had given her a small vessel of honey as a gift and that she gave the Prophet (may Allah's peace and blessings be upon him) a drink of it. ‘Ā’ishah (may Allah be pleased with her) felt jealous and planned, together with Sawdah and Safiyyah, that when the Prophet (may Allah's peace and blessings be upon him) visited any of them, she would ask him whether he had eaten Maghāfīr, which is a foul-smelling gum. The noble Prophet (may Allah's peace and blessings be upon him) hated that any unpleasant odor should ever emit from him. So when he visited Hafsah (may Allah be pleased with her) again and she offered honey to him, he declined it. In another version: “He swore that he would never drink it again.” Different versions of this Hadīth differ over who gave the Prophet (may Allah's peace and blessings be upon him) the drink of honey. It has been mentioned that he had drunk it in the apartment of Zaynab or Sawdah. Some scholars deemed it more likely that Zaynab was the one who gave him the drink of honey and that Hasfah was ‘Ā’ishah’s partner in the plan. Some scholars proposed that the different versions might refer to more than one story.

In this Hadīth, the Prophet (may Allah's peace and blessings be upon him) explains that one can handle only things that he owns, and that disposing of things that one does not own is void. This rule applies to the acts mentioned in the Hadīth as follows: 1. The vow: Making a vow concerning a thing that one does not own at the time of making the vow is void. Even if one comes to own that thing later, he neither has to fulfill his vow nor offer expiation. 2. Emancipation of a slave: One cannot free a salve who is not his, because emancipation in this case in objectless. 3. Divorce: It is void if made by a man concerning a woman who is not his wife, because the right of divorce belongs exclusively to the husband who has the right to intimacy, and also because the Prophet (may Allah's peace and blessings be upon him) said: “One cannot divorce a woman who is not his (wife)”.
